CMS releases addition information on DMEPOS competitive bidding project

The April 21 issue of Device Regulation Alert discussed some new MLN Matters Articles addressing DMEPOS competitive bidding. CMS has released another article on the topic, this time discussing exceptions and special circumstances involved in the competitive bidding project.
Situations the article addresses include:
- Physicians who provide patients DMEPOS without submitting bids and winning a contract when certain conditions are met
- A specific brand prescribed to avoid adverse events
- Skilled nursing facilities and nursing facilities that offer DMEPOS to their own residents
Some providers and suppliers operating outside the competitive bidding areas (CBAs) can still be affected by the program because beneficiaries who live in the CBAs can still be subject to program requirements even if they travel outside the CBA.
In the same press release announcing the new MLN Matters article, CMS also warns that it is imperative to use advance beneficiary notices (ABNs) for DMEPOS items under the bidding program because of the various circumstances affecting Medicare payment for these items. A new ABN form was released in March and can be used immediately. The new ABN form becomes mandatory September 1.
Finally, CMS will hold a national provider conference call for providers affected by the competitive bidding program May 13. CMS promises more information will be released prior to the call.
