Louisiana AG drops suit against Amgen

Louisiana’s new attorney general (AG) decided not to follow through on his predecessor’s suit against Amgen, according to a CNNMoney.com article.

On his last day in office, former AG Charles Foti filed a multimillion dollar antitrust suit accusing Amgen of illegal pricing practices. Foti claimed Amgen was trying to monopolize the market on oncology drugs sold to clinics by penalizing clinics that failed to purchase significant volumes of Amgen’s Aranesp.

On April 8, current AG James Caldwell dismissed the case, but retained the right to refile it. The suit is similar to a federal lawsuit filed in New Jersey.
