Abbott accused of blocking generic

Eighteen states and the District of Columbia are so sure Abbott Laboratories and Solvay's Fournier unit illegally blocked generic competition for their cholesterol medication TriCor, they're taking the companies to court.

The suit alleges Abbott and Fournier brought more than 10 sham patent-infringement lawsuits against the generic companies between 2000 and 2004, according to a press release by Iowa Attorney General Tom Miller. Abbott and Fournier either lost or dismissed all of the suits. The two companies also allegedly made minor changes to TriCor's formula to stop generic competition.

The civil lawsuit against Abbott and Fournier seeks triple the amount of damages incurred by the states' public health agencies, and also seeks damages incurred by individual consumers.

The Federal Trade Commission (FTC) filed a similar suit against Cephalon last month. In that suit, the FTC claims Cephalon made payments totaling slightly more than $200 million to four generic manufacturers so they would delay a generic drug's entry into the market until 2012.
