Washington tries to ban data mining

Pharma Compliance Alert, March 12, 2008

Legislators in Washington state are the latest to try to curb data mining, according to an article in the Seattle Post-Intelligencer.

Data mining laws in Maine and New Hampshire have already been struck down as unconstitutional in court challenges. A proposed law in Vermont currently faces legal challenge. Earlier this year, Washington D.C. removed a ban on data mining from a bill requiring pharmaceutical sales representatives to be licensed.

The proposed Washington state law would ban collecting prescription data from pharmacies and cross-matching it against doctors' prescription ID numbers. The bill would make exceptions for research and product-recall purposes.

The bill passed the Senate by a narrow margin and also was passed out of the House Health Care and Wellness Committee. According to the article, the bill may not have enough votes to bring it to the House floor for debate.
