Montana AG sues Janssen, AstraZeneca

Montana Attorney General Mike McGrath became the latest to file suit against Janssen and AstraZeneca over the atypical anti-psychotics Risperdol and Seroquel.
In the suit McGrath claims the drugs were "in defective condition and unreasonably dangerous."
The suit contends the companies failed to warn physicians and consumers about the dangers of the two drugs. The AG said the companies engaged in false and misleading marketing, advertising, and sales campaigns promoting off-label uses of the drugs.
McGrath seeks civil penalties of $10,000 for each violation of state law, an order returning to the state all revenues made by the two companies here for sales of the drugs to Montanans, restitution, triple damages, and attorney fees. McGrath also asked the court to award punitive and exemplary damages as appropriate.
Lawsuits have been filed against both companies in Arkansas, Pennsylvania, and South Carolina, while Janssen faces an additional suit in Louisiana.
