Federal grand jury to examine Vioxx marketing

A federal grand jury is investigating whether Merck promoted its painkiller Vioxx for off-label uses, according to an article in The Wall Street Journal.

Merck pulled Vioxx from the market in 2004 after a study linked it to an increased risk of heart attacks and strokes. The company tentatively agreed to a $4.85 billion settlement for lawsuits filed by people who claimed they were injured by Vioxx.

In a regulatory filing, Merck stated the Department of Justice subpoenaed information relating to the company's research, marketing, and sales of Vioxx. In addition 31 state attorneys general and the District of Columbia are investigating the sales and marketing of Vioxx.
