Judge rules Wyeth not negligent in Prempro suit

A Philadelphia judge overturned a $3 million verdict against Wyeth because the plaintiff did not have enough evidence to show Wyeth's Prempro caused her breast cancer.
Philadelphia Common Pleas Senior Judge Ricardo C. Jackson ruled the woman did not show her physician would not have prescribed Prempro if the warning had been better. He also said the plaintiff failed to prove Wyeth's negligence directly led to her breast cancer.
The decision could help Wyeth defend itself against the thousands of other Prempro lawsuits that have been filed, including approximately 1,500 filed in Philadelphia. A jury recently awarded three women in Nevada $134 million in their suit against Wyeth.
