New HHS rule won't affect IT donations

The new HHS rule governing physician referral practices under the Stark Act does not materially change IT donation programs approved by HHS in August 2006, according to a September 5 Health Data Management article.
HHS made what it terms "nonsubstantive technical changes" in language covering IT donations in the new final rule, which is called Phase III and was published in the Federal Register on September 5. The new final rule replaces an interim final rule issued several years ago.
