Retail Health Care Facility Permit Act takes next step toward approval

Ambulatory Surgery Reimbursement Update, June 19, 2007

The Illinois General Assembly re-referred Bill 1885, known as the Retail Health Care Facility Permit Act, to the Assembly's Rules Committee on May 25, according to the American Association of Ambulatory Surgery Centers (AAASC) state advocacy Web site.

The bill was originally introduced February 23 by Representative Michael P. McAuliffe (R-IL).

The bill intends to do the following:

  • Provide care of individuals in retail healthcare facilities
  • Provide better protection of the public health through enforcement standards
  • Allows construction, maintenance, and operation of retail healthcare facilities
  • Enforce denial, suspension, revocation, or nonrenewal of a permit, when applicable
  • Include monetary penalties for violation of the Act
  • Restrict advertising by retail healthcare facilities

As stated in the bill, a retail healthcare facility is defined as "any institution, place, or building, or any portion thereof, devoted to the maintenance and operation of facilities for the performance of healthcare services and located within a retail store or pharmacy; requires a permit for the operation of such a facility, issued by the Department of Public Health, and sets forth requirements for obtaining a permit."
