Most healthcare CIOs don't plan on donating HIT to physicians

A recent College of Healthcare Information Management survey of healthcare chief information officers (CIO) shows that 62% of respondents do not plan to donate health IT (HIT) in the form of EHRs to private physicians, even though the new Stark exception and anti-kickback safe harbor allows it. CIOs are concerned that the government could reverse the exception and that the law is subject to interpretation.

The 38% of respondents who do plan to take advantage of the relaxed laws are planning to donate HIT in the form of software, implementation support, training, and help-desk support. An independent GE Healthcare study reveals that physicians would prefer to receive an EHR donation from a local hospital or integrated delivery network rather than from an insurance company, RHIO, or EHR vendor. The CMS and OIG final rules create new exceptions and safe harbors to federal fraud-and-abuse laws, including the Stark law.
