New Jersey considers HIV testing requirements

Infection Control Monitor, March 30, 2007

New Jersey would become the first state in the nation to require HIV testing for both pregnant women and newborns if proposed legislation unveiled last week is approved.

Senate President Richard J. Codey announced his plans to introduce legislation to require the testing unless a mother specifically chooses in writing to reject the test, reported Time magazine. Under the plan, hospitals and other birthing facilities would be required to test newborns in their care.

According to the Kaiser Foundation, four states--Arkansas, Michigan, Tennessee, and Texas--now require healthcare providers to test a mother for HIV, unless she asks not to be tested. Two states--Connecticut and New York--test all newborns, the magazine reported.
