Nurse pleads guilty to taking residents' drugs
LTC Liability Monitor, March 6, 2007
A nurse pleaded guilty last week to switching out painkillers meant for nursing home residents to keep for himself, the U.S. Attorney's office said in an Associated Press (AP) story. Michael Paul Smith of Falmouth, MA, pleaded guilty in U.S. District Court to tampering with consumer products and healthcare fraud. He is scheduled for sentencing on May 24, when he faces up to 10 years in prison and a $250,000 fine. Smith also faces mandatory exclusion from working in any federal healthcare program. Prosecutors said Smith took pills containing oxycodone and morphine and substituted them with similar looking medication. No residents were injured, according to the AP.
