Court maintains award in wrongful death suit
LTC Liability Monitor, November 20, 2006
The Delaware Supreme Court upheld a $13 million wrongful death law suit in favor of the family of an Alzheimer's resident, reported the Delaware News Journal. Attorneys for the facility argued that the judge made mistakes during the trial, but court officials weren't convinced. The resident died after she wandered into a freezer and ended up locked inside for more than four hours. She suffered frostbite and died as a result of her injuries several weeks later. The resident's family sued for wrongful death, and before the trial nursing home officials conceded that the resident died as a result of their negligence, according to the Journal.
