Case may set legal precedent in Florida
LTC Liability Monitor, November 13, 2006
A jury will decide whether a nursing home resident was deprived of her right to die with dignity, reported the South Florida Sun Sentinel. Attorneys say the case could set legal precedent in Florida. The lawsuit claims the resident was intentionally battered when life-prolonging measures were taken despite the fact that she had a living will and advanced directives instructing the opposite. On her last day in the nursing home, staff found the resident unresponsive with no blood pressure reading. Paramedics were called anyway and intubated the resident without anesthesia, according to reports. She later tried to remove the tubes, leading paramedics to restrain her, attorneys said. She died after six days of invasive treatments, reported the Sun Sentinel.
