Florida court decisions could pave way for faster, proper insurance payments

The Florida Supreme Court ruled October 19 that a group of doctors can sue two insurers over allegations that the physicians were not paid promptly for claims, according to a story in The Miami Herald.
The ruling will allow Westside EKG Associates, a group of Broward, FL, physicians, to sue Humana and Blue Cross Blue Shield of Florida.
The ruling came just a day after the Fourth District Court of Appeals upheld the right of an orthopedic surgeon, Peter Merkle of Pompano Beach, to sue several insurers over allegations that the surgeon was not receiving proper payments for out-of-network services provided.
Attorneys representing Westside EKG Associates and Merkle said they plan to "seek class-action status so they can go forward representing all the doctors in the state on payment issues," according to The Miami Herald story.
"This affects all healthcare providers in the state,'" said Jeff Liggio, attorney for Westside EKG, according to the story. "It levels the playing field."
