State of Texas sues nursing home

LTC Liability Monitor, October 23, 2006

The state of Texas is suing a Richland Hills nursing home, accusing it of failing to properly treat a resident who died as the result of an untreated urinary tract infection in 2004, according to the Fort Worth Star-Telegram. The state rarely sues nursing homes and views legal action as a last resort to force a home to correct problems, said a Texas Department of Aging and Disability Services representative. The lawsuit states that the facility violated minimum health and safety standards. It seeks damages of $1,000 to $20,000 for each violation, number unknown, that the state determines threatened a resident's safety and health, according to the Star-Telegram.
