South Carolina prohibits PTs from working for physicians

The South Carolina Supreme Court recently concluded to prohibit a PT from working as an employee of a physician when the physician refers patients to the PT for services, according to a release by the South Carolina Physical Therapy Association (SCPTA).

The Supreme Court also affirmed that this ruling did not improperly infringe upon physicians' statutory rights to practice medicine, violate appellants' equal protection rights, or violate appellants' substantive and procedural due process rights.

The ruling came after a physician challenged the South Carolina Physical Therapy Practice Act, which prohibits a PT or PT assistant (PTA) from working for a referring physician.

This confirms that all PTs and PTAs in South Carolina employed by a physician or group of physicians who refer patients to them are out of compliance with current state law and subject to disciplinary action by the South Carolina Board of PT Examiners, according to the SCPTA release.
