Nursing home owners indicted

LTC Liability Monitor, September 27, 2006

A grand jury issued indictments last week of two Louisiana nursing home owners for negligent homicide in the drowning of 35 residents, reported The Times-Picayune. The owners are charged with 35 counts of negligent homicide and 64 counts of cruelty to the infirm. The couple allegedly ignored a mandatory evacuation order and refused an offer to bus the residents to safety a day before Hurricane Katrina hit New Orleans, authorities have said. The owners defend their choice not to evacuate because they were worried some of the residents wouldn't survive the ordeal. Earlier this month, they sued some government officials arguing that the authorities should share in liability as officials did not undertake their own evacuation effort, reported The Times-Picayune.
