Estate recovery law nixed by feds

Federal officials rejected a new state law in Georgia that would have protected more residents from a Medicaid estate recovery plan intended to recoup costs of nursing home care after patients die, reported The Atlanta Journal-Constitution. CMS notified state officials last month that it will not approve changes to the state's plan to recover a portion of the money Medicaid spends on residents in nursing homes, facilities for the mentally retarded, or on adults 55 and older who get community- and home-based services. The law intended to preserve estates from recovery was contingent on federal approval, according to the Journal-Constition.
