EHR technology receives safeharbor guidelines
The Department of Health & Human Services (HHS) has announced final regulations governing safeharbors for physicians adopting electronic prescribing and electronic health record (EHR) technology, according to a HHS press release.
The regulations create exceptions to the physician self-referral law and the federal anti-kickback statute, establishing conditions under which entities may provide physicians (and certain other recipients under the safeharbor) with interoperable EHR software, information technology, and training services.
The scope of donors and recipients under the final rules is considerably broader than in the proposed rules, according to the press release. Among other conditions, the final rules include a cost-sharing requirement in which recipients are required to pay 15% of the cost of associated items and services.
