Physician lies under oath
LTC Liability Monitor, August 2, 2006
The Chief Medical Officer of Catholic Health Services for the Archdiocese of Miami admitted that his sworn testimony at a deposition was contradictory to his testimony at a related trial involving a former patient, reported Medical News Today. At issue was whether a transfer to a nursing home from an assisted living facility (ALF) would have prevented a resident fall that resulted in severe injuries and hospitalization. During the physician's deposition he testified that the resident did not have dementia or Alzheimer's disease and therefore did not need to be transferred to a nursing home for a higher level of care, according to the report. At trial, the physician changed his testimony and said that the resident was demented and had Alzheimer's disease at the time of the incident. The new testimony changed the amount of damages the resident was entitled to, reported Medical News Today.
