CMS amends the use of the KX modifier

CMS has identified a glitch in its system regarding the use of the KX modifier, according to the agency. The glitch requires providers to now attach the modifier on all line items on the same claim form for patients over the therapy cap who qualify for an exception.
CMS' revised instructions are effective immediately and stem from a problem when providers billed for speech-language services and physical therapy services on the same claim.
Providers should resubmit any claims that Medicare fiscal intermediaries denied because of this processing error.
In a recently released article published by CMS in its MedLearn Matters, the agency states that providers will not be penalized for using the KX modifier on medically necessary services that would be eligible for an exception when those services are below the cap and filed on the same claim form as services that meet the exceptions process criteria.
