New Medicaid rules a cause for concern

LTC Liability Monitor, June 15, 2006

Long-term care providers are concerned about the effects of a new law that will require verification of U.S. citizenship status for people seeking Medicaid benefits. The fear is that people with dementia and mental illness, especially those living in nursing homes and other long-term care facilities may be at risk of losing or being denied Medicaid benefits under the new law, which goes into effect July 1.

"Many of these people have cognitive impairments so severe that it is not possible for them to be of any assistance in locating the required documentation, and they do not have families that can assist," wrote Bruce Yarwood, president and CEO of the American Health Care Association. In a letter to the Department of Health and Human Services, Yarwood urged officials to consider grandfathering in current nursing home residents.
