Senate rejects malpractice award caps

Physician Practice Advisor, May 10, 2006

The Senate on Monday rejected two Republican-backed bills dealing with malpractice damages, effectively pushing malpractice reform off the agenda for this year, according to a report by The New York Times.

The first bill would have capped jury awards in all lawsuits against doctors and healthcare institutions, and the second would have applied caps only to cases involving obstetricians. Both bills fell short of the 60 votes needed to proceed.

In what has been referred to as Health Week in Washington, Senators will also vote this week on legislation relating to health insurance coverage for mammograms, annual children's physicals, and drug abuse counseling.
