Woman fired over asthma attack wins lawsuit
Respiratory Care Weekly, April 19, 2006
Score one for the asthma patients: Carly Simpson, an 18-year-old Scottish bar waitress who was canned after suffering an asthma attack at work, won £6,000 (US $10,650) in a lawsuit against her former employer. Her complaint alleged unfair dismissal and disability discrimination, according to The Scotsman of Dundee, Scotland.
Simpson found herself out of a job after one particularly stressful night at work she stepped outside to wheeze and cough during an asthma attack. She told the tribunal handling the case that a week after the incident she wasn't on the work schedule and when asked why, her boss told her he was alarmed by the asthma attack and feared for her health. Her boss testified that he'd wanted to move her to a coffee shop he also owned, but the tribunal nevertheless awarded her the monetary damages, reported The Scotsman.
