Massachusetts CNA fired after reporting facility rape
LTC Liability Monitor, March 9, 2006
A certified nursing assistant (CNA) at a Brockton, MA, nursing home was fired after reporting a sexual assault at her facility to state officials, reported the Boston Herald. Miranda Jorge, who worked at St. Joseph's Manor Nursing Home, told the newspaper that her supervisors did not report the suspected rape of a 91-year-old male resident by a male CNA. Jorge called the state Department of Public Health with an anonymous tip about the incident, but also told several co-workers she had reported it.
St. Joseph's administrators maintain Jorge was fired for talking back to a resident who scolded her. State investigators last month recommended fines of $3,500 per day against St. Joseph's until it puts safeguards in place to prevent future assaults. Jorge told the Herald she will likely file a complaint under Massachusetts' whistleblower law.
