AHA: Government should clarify anti-kickback, self-referral rules to boost EHR adoption

The government should expand its proposed changes to anti-kickback and physician self-referral rules for hospitals to provide health IT tools and training to doctors, according to the American Hospital Association (AHA).

In its letter to the Office of the Inspector General (OIG), the AHA said the current proposed changes fall short for many reasons, such as failing to offer actual regulatory language for an anti-kickback safe harbor.

The AHA also said the covered technology must be broadened to include EHR hardware, software, training, connectivity, secure messaging, ongoing support and maintenance, and interfaces that allow physician offices to exchange EHR data with hospital systems. In its letter to CMS, AHA calls for an exception to the Stark rules for e-prescribing and EHRs.
