Settlement reached in 2003 Texas SNF death

LTC Liability Monitor, November 3, 2005

A wrongful death lawsuit prompted by the 2003 choking death of a SNF resident in Plainview, TX, was settled for $700,000 this week, the Houston Chronicle reported. The settlement includes no admission of responsibility or liability by the Prairie Center Living House nursing home, whose lawyers contended the former resident's dementia caused her continuous choking problems.

In addition, the $700,000 represents only actual and no punitive damages, whereas the suit originally sought $2.5 million in actual and exemplary damages, the Chronicle reported. Prairie House continues to operate.
