Manufacturers file suit to delay PMD policies

Suppliers and manufacturers of power mobility devices (PMD) filed suit last week to prevent the Centers for Medicare & Medicaid Services (CMS) from implementing new Medicare policies, even though the agency delayed implementing the new billing codes that were scheduled to take effect in January, reports PT Bulletin Online.
Other provisions of the new policies are still scheduled to take effect October 25 unless a federal district court issues a preliminary injunction to stop them.
The Power Mobility Coalition, a national coalition of PMD manufacturers and suppliers, alleges that CMS has failed to provide proper notice and permit public comment before the new policies go into effect.
The coalition objects to the replacement of certificates of medical necessity with what it argues are vague and subjective documentation requirements. Others have raised concerns with CMS that the new regulations restrict the role of physical therapists in conducting face-to-face examinations of Medicare beneficiaries.
