New York SNF sued over misconduct, racial slurs

LTC Liability Monitor, October 5, 2005

The U.S. Equal Employment Opportunity Comission (EEOC) slapped a Flushing, NY, nursing home with a federal lawsuit this week, accusing it of racial discrimination and malicious indifference toward its black employees, Newsday reported. The suit alleges some managers of Flushing Manor Geriatric Center directed racial slurs at the caregivers, and also imposed harsher disciplinary practices and stricter supervision on them than on other employees.

The suit names four plaintiffs, but the EEOC told Newsday that the class action suit could cover many other current and former Flushing Manor workers going back to the late 1990s. The plaintiffs said that among other offensive language that apparently went unchallenged, managers allowed the residents to call them "monkeys." The lawsuit seeks punitive damages.
