New York CNA jailed for breaking resident's arm
LTC Liability Monitor, September 1, 2005
A Newburgh, NY certified nursing assistant (CNA) will serve eight weekends in prison after breaking the arm of a 92-year-old resident earlier this year, reported the upstate New York Times Herald-Record. Quiana Mays, fired from Elant at Newburgh nursing home and now prohibited from any SNF work in the state until she's off probation, was charged this week with endangering the welfare of an incompetent or physically disabled person.
She allegedly broke a resident's arm while attempting to move her from a wheelchair to a bed. After at first denying she had done anything wrong, she admitted to Town of Newburgh Court she had failed to take proper precautions when using a mechanical lift, the Times reported. The resident's care plan necessitated that two people transfer her, but Mays reportedly attempted the move by herself, and was initially suspended without pay when another CNA noticed the resident's arm was swollen and warm to the touch.
