Ohio nursing home cited in sunbather's death

LTC Liability Monitor, July 13, 2005

The Ohio state health department cited a Waterville-based nursing home this week after a 49-year-old resident died while sunbathing. Patricia Matney, who had multiple sclerosis and was unable to move, lay out in the sun for several hours and her body temperature reached approximately 109 degrees, according to the Associated Press.

Heartland of Waterville nursing home could not verify whether Matney was monitored over several hours in the afternoon, NBC reported, and the nursing home was also cited for its lack of a sunbathing policy for residents. Matney's family has filed suit against HCR Manor Care and Heartland of Waterville. The lawsuit claims negligence, wrongful death, and liability, and the Matney family is reportedly seeking millions in compensatory and punitive damages, according to ABC.
