North Carolina fixes background check law

LTC Liability Monitor, March 16, 2005

The North Carolina legislature has approved a slightly altered version of a 2004 criminal background check law, the Associated Press reported. The FBI opposed an earlier version of the bill because of concerns over how state regulators would distribute the information obtained from checks on potential nursing home employees.

Under the new law, the state Department of Health and Human Services will notify a nursing home only of results that would affect the "employability" of the applicant, according to AP. The bill must now go before Gov. Mike Easley for his signature.
