Kennedy bill would limit nurse overtime

Sen. Edward M. Kennedy (D-MA) introduced legislation last week that would fine hospitals for requiring nurses to work mandatory overtime after completing scheduled shifts.
Hospitals could be subject to $10,000 fines and nurses could file complaints about overtime violations to the U.S. Department of Health and Human Services, according to the bill. The department could impose fines or raise fines against repeat offenders upon investigation.
The bill will help improve patient safety and entice more young people to enter nursing, Kennedy said. U.S. hospitals are facing a shortage of 126,000 nurses, according to the Kaiser Family Foundation.
A University of Pennsylvania School of Nursing study released in 2004 showed that nurses who worked 12 1/2 hours or more were three times as likely to make an error than a nurse who worked 8 1/2 hours.
