Nurse anesthetics can continue working with surgeons

Nurse anesthetics in New Jersey can continue, for the time being, to work with surgeons in an office setting thanks to a stay granted by the state's Supreme Court.

On February 1, 2005, the court granted the New Jersey Association of Nurse Anesthetics (NJANA) the motion that prevents the "implementation and enforcement of restrictive office surgery and anesthesia rules pending the outcome of legal proceedings in that court," according to a release posted on the American Association of Nurse Anesthetics (AANA).

The restrictive rules state, amongst other limitations, that supervising physicians must have anesthesia privileges before working with certified registered nurse anesthetists in office-based settings, or they must apply to the New Jersey State Board of Medical Examiners for alternative privileges.

This issue reached the Supreme Court after NJANA filed a petition requesting the court to review a November 2004 decision by an appellate court upholding the restrictive rules. The AANA expects the Supreme Court to issue a decision on whether to review the case within the next several weeks.
