Resident sues ALF for alleged negligence
LTC Liability Monitor, February 10, 2005
An 82-year-old woman is filing a lawsuit against an ALF, alleging that it failed to provide adequate security on the night she was raped, reported the Wisconsin State Journal. The lawsuit alleges that Madison, WI-based Meriter Health Services Inc. was negligent because an outside door was left open at 2:27 a.m., the time of her attack. The lawsuit indicates there was no type of warning device that could have alerted staff that a door was open. There was also no one monitoring the video cameras that later showed the offender entering the building. The lawsuit also faults Meriter for failing to provide adequate staffing, with only one person on duty the night of the attack, according to the Journal.
