Company found guilty of manslaughter

LTC Liability Monitor, January 26, 2005

In an unusual court case, a health care company was convicted of manslaughter in connection with a Connecticut nursing home death, the Hartford [CT] Courant reported. Hillcrest Health Care, Inc. pleaded guilty to second-degree manslaughter in the death of Jacob E. Oberman, a Montville, CT, nursing home resident. Oberman was suffering from malnutrition, dehydration, anemia, and severe sepsis stemming from an infected pressure sore when he arrived at the local hospital emergency room. He died a day later.

The state's chief attorney said he thinks this is the first time a nursing home company, rather than an individual, was criminally charged. The state department of health levied its largest ever fine against the home-$200,000-and demanded the facility be sold, according to the Courant. A suit brought by Oberman's family and state and federal cases are pending.
