Bush demands tort reform

LTC Liability Monitor, January 12, 2005

President Bush called for a $250,000 cap on noneconomic damage awards-including physical and emotional pain and suffering-in medical malpractice cases, the New York Times reported. The president made his remarks last week before an audience in Collinsville, IL. In the past, bills limiting damages in medical malpractice litigation have been approved in the House of Representatives but not the Senate. Republicans hope their increased majority in the Senate will help push the newest bill through. Advocates say tort reform would protect nursing homes, doctors, health maintenance organizations, and drug and medical device manufacturers from excessive payments in lawsuits. The president says the law would not limit economic damages, medical expenses, and lost wages, according to the Times.
