FBI blocks background checks
LTC Liability Monitor, January 5, 2005
The FBI is preventing North Carolina officials from putting into effect a law that would enable nursing homes to conduct national criminal background checks on most employees, reported the Raleigh, NC, News & Observer.
The law, which was to take effect January 1, would allow nursing homes to check the criminal record in every state of employees who come in contact with residents-from nurses to food service workers. The state department of Health and Human Services would provide the results of the background checks to the facility's management.
The FBI says this violates federal statutes, according to the News & Observer, and is requiring legislators to change the language of the law to comply with federal rules.
