State Supreme Court limits families' ability to sue

A decision by the Florida Supreme Court last week limited a family's ability to sue for neglect or abuse if their family member dies of unrelated causes, reported the Miami Herald. Under Knowles vs. Beverly Enterprises, if a LTC facility resident's death is unrelated to an alleged abuse, the family has no bearing to sue for the prior abuse.
According to the Palm Beach Daily Business Review, Maggie Knowles sued the owners of the nursing home at which her husband was a resident for neglect after he died. Gladstone Knowles allegedly suffered from pressure ulcers, permanently locked limbs and dehydration, but died of congestive heart failure.
