Whistle-blower lawsuit settled

LTC Liability Monitor, November 30, 2004

A Chicago nursing home has settled a lawsuit brought by two whistle-blowers alleging Medicaid fraud, severe patient abuse, and deplorable physical conditions, according to the Chicago Tribune.

Two companies and four managers associated with Maxwell Manor have agreed to pay more than $1.6 million in damages, while denying any wrong-doing. The former employees-a facilities program coordinator and a psychiatric rehabilitation services coordinator-contend that patients lived in unsafe physical conditions, were under- and overmedicated, and physically, sexually, and mentally abused. They also allege the home routinely falsified patient charts and billed for services that were not administered.

Maxwell Manor was closed by state and federal inspectors in 2000, shortly after the lawsuit was filed, reported the Tribune.
