No cap on punitive damages in Arkansas

Arkansas lawmakers will not revisit an earlier attempt to limit damages awarded in lawsuits against nursing homes, according to the Associated Press (AP). Plans to cap punitive damages at $1 million in suits against nursing homes will not be reintroduced in the 2005 legislative session.
A representative from the Arkansas Health Care Association said his group would not bring forth any tort reform, reported the AP. The Arkansas legislature passed a bill in 2003 limiting liability in damage suits against nursing homes.
