Housing agency settles federal discrimination suit

LTC Liability Monitor, October 14, 2004

The Vancouver Housing Authority will pay $100,000 to settle discrimination charges filed with the U.S. Department of Justice, The Oregonian reported.

The lawsuit alleged the housing authority discontinued the assisted living services of two clients because of their disabilities-thereby violating the Fair Housing Act.

Assisted living residents in two Oregon facilities were moved into one facility as a result of a state law requiring facilities to house elderly residents and residents with disabilities on common floors in an effort to provide better care. The two residents alleged that they were forced to choose between the continuation of their assisted living services and a handicapped accessible apartment.

Coldwater Springs Assisted Living Community LLC, Sunwest Management Inc., and Emeritus Corp.-the companies that run the assisted living program for the housing authority-will pay $65,000 to the two residents who filed the suit, and $35,000 to two others who were also forced to choose between a suitable environment and assisted living services, according to The Oregonian.
