Case dismissed against employers of murderous nurse
LTC Liability Monitor, September 16, 2004
A New Jersey Superior Court judge dismissed lawsuits against three hospitals and one nursing home that employed former nurse Charles Cullen, who confessed to killing up to 40 patients, the Associated Press (AP) reported.
The judge ruled the healthcare providers were not obligated to contact future employers about their suspicions or knowledge of Cullen's activities. Attorneys for the providers argued that the facilities were not legally obligated to alert future employers, and were unsure of how to do so had it been required.
The judge left open the possibility for the plaintiffs-two victims' families-to amend their complaints and make the case that the facilities were contacted by prospective employers and gave false or incomplete information about Cullen, AP reported.
