Nursing home settles case of fatally burned resident
LTC Liability Monitor, September 8, 2004
A Georgia nursing home owned by Beverly Enterprises settled for an undisclosed amount a wrongful death lawsuit with family of a 49-year-old resident, the Associated Press (AP) reported.
Windermere Adult Day Health Center in Augusta, GA, did not properly supervise the resident, who suffered third-degree burns while trying to light a cigarette, according to the lawsuit.
The resident's care plan specified he should be closely watched while smoking, but the incident took place while he was alone in the facility's courtyard, AP reported. The suit alleged malpractice, negligence, and wrongful death.
