SNF settles lawsuit over feeding tube death

LTC Liability Monitor, September 1, 2004

Care Center of Rossmoor in Walnut Creek, CA, answered to regulators and family members after nurses accidentally inserted a feeding tube into a resident's right lung rather than his stomach, reported The [Fremont] Argus.

The 180-bed skilled nursing facility (SNF) paid a $75,000 fine to the state department of health and settled for an undisclosed amount a wrongful death lawsuit filed by family members. As part of the settlement, the SNF agreed to strengthen its training procedures for all nursing staff-an action the plaintiffs' attorney called "precedent setting."

The resident was sent to the hospital seven hours after staff inserted the feeding tube, and died of respiratory failure, lung abscess, and aspiration pneumonia, according to The Argus.
