Nursing home operator sued for overtime pay

In anticipation of the federal Department of Labor's (DOL) new rules governing overtime pay-which became effective on Monday-overtime issues have been catapulted into the spotlight.
With overtime complaints causing a rising number of class action lawsuits, the DOL intends the new provisions to clarify which employees are eligible for overtime pay to solve problems before they become lawsuits, according to an agency press release.
Meanwhile, a class action lawsuit originally filed last year in Long Island against nursing home operator McGuire Group continues to gain momentum, the Buffalo [NY] News reported. Current and former employees of the chain received letters about joining the lawsuit last month.
The suit claimed McGuire Group-which operates eight facilities in New York and one in Michigan-did not pay overtime when it was due and told workers they should have finished their work faster. Chain president James McGuire called the lawsuit a frivolous action taken by disgruntled ex-workers, according to the News.
