New York passes assisted living reform
LTC Liability Monitor, August 19, 2004
State legislators approved a bill on August 12 to increase supervision and limit who can provide services as an 'assisted living facility' (ALF) in New York, according to [New York] Newsday.
The New York state legislature unanimously passed a bill that clearly defines an ALF as a facility that offers housing, monitoring, and personal care in a home-like setting.
All entities referring to themselves as ALFs must now be licensed by the state Health Department. Facilities offering services to residents with dementia or other serious health needs must obtain additional certification.
The bill also mandated a resident bill of rights, plain-language contracts, and a service plan for each resident that must be updated every six months, according to Newsday.
