Feeding assistant rule to be challenged in court
LTC Liability Monitor, August 4, 2004
A class action lawsuit over the use of feeding assistants was filed this week on behalf of nursing home residents nationwide in the U.S. District Court in Seattle, the Seattle Times reported.
The lawsuit challenges a 2003 federal regulation allowing nursing homes to hire low-paid employees with eight hours of training to assist residents with eating and drinking.
The lawsuit takes issue with the minimum training requirements set forth in the regulations and the fact that feeding assistants would not be included in state registries that track complaints of abuse and neglect against nurses and certified nursing assistants, reported the Times.
