Advocacy group seeks to warn of arbitration
LTC Liability Monitor, July 14, 2004
As more of the state's nursing homes include arbitration agreements in their admissions packets, Arkansas Advocates for Nursing Home Residents repeated its request that Attorney General Mike Beebe's office warn consumers about their nature, the Arkansas Democrat-Gazette reported.
Typically, the agreements require nursing home residents or their representatives to settle complaints of abuse or neglect through third-party arbitrators instead of the court system.
Industry representatives say arbitration agreements lead to faster claims processing and rely on legally trained persons to solve disputes rather than emotionally charged juries. Arkansas Advocates says it's a way for facilities to avoid accountability. The group also fears consumers will not understand the contracts and advises them against signing.
Beebe will consider the request and promised a response, according to the Democrat-Gazette.
